This was adopted on 8th June 2000 to facilitate communications trade across all the jurisdictions unifying each country's national legislation. National Governments have until 16th January 2002 to implement this. It seeks to provide: -
  • Anti-junk email consumer protection measure prohibiting unsolicited emails.
  • Double acknowledgement rule for contract certainty.
  • Regulation of Service providers.
  • Requirements to ensure consumer confidence and fair trading.
  • Facilitation of national legislation to allow for online contracts.
  • Establishments of mere conduit rule limiting ISP's liabilities.
  • Monitoring and enforcement of EC and national Legislation.
Some of these provisions have been included in the electronic Communications Act 2000 (Power of Minister to remove any prohibitions or restrictions in other legislation).
